ILATI TERMS AND CONDITIONS OF SERVICE
IMPORTANT NOTICE:
Before you order: If you use our servers for illegal activity, pornography, phishing sites, sending of spam email or spam comments, fraudulent activity, copyright violation, your site will be suspended immediately and NO refund will be issued.Ilati reserves the rights to change these policies at any time, so please, check this page when in doubt. By opening an account with Ilati, you signify that you agree to be bound by these terms and conditions.
Ilati reserves the right to refuse service or cancel existing accounts for any reason at any time. In the event of an account cancellation by Ilati or the customer, Ilati will not issue a refund unless the account is within the 30 day money back guarantee timeframe.
PAYMENT POLICY
Full payment is required before any hosting service is rendered, which includes renewals. Prepayment is due at the time of ordering your Ilati hosting plan, and then depending on the billing cycle after that.
You can pay for your Ilati hosting account in one of three ways.
- Paypal (From your Paypal balance or via your credit card using Paypal).
- Cheque / Money Order (Australian or International in AUD$)
- Bank Transfer (Direct deposit)
Invoices are issued and due seven (7) days later. Should a due date fall on a weekend on public holiday your invoice will be due next business day.
We reserve the right not to send a warning regarding account suspension and failure to pay your invoice within seven (7) days of your due date will result in suspension of all your services you hold with us until full payment is received. Your account will be terminated after thirty (30) days after the due date. However, that said, if you're having problems with paying, let us know, and we'll look and see if we can work something out. We're more than willing to work with you, rather than just suspend your account for non payment.
There is no minimum contract period with any of our accounts, although we are not able to refund any period in part.
Ilati reserves the right to change our fees at any time however, the price that you purchased your Ilati account at, will remain locked into that pricing, and will not be affected by future price rises for as long as your account remains in good standing (no overdue accounts).
Ilati offers a 30 day money back guarantee. If you are not satisfied with our service, and wish to cancel, we will issue you a full refund, less any transaction fees occurred in processing your payment. Just contact us by opening a support ticket in our helpdesk or emailing support@ilati.com.au. Please note DOMAIN REGISTRATIONS are not refundable.
If an account is cancelled by Ilati due to a violation of our terms of service, there will be no refund issued. All monetary transactions are in Australian dollars only. To cancel your account, please email support@ilati.com.au or submit a support ticket in the client centre.
INDEMNIFICATION
Ilati is not responsible for lost revenue, traffic or data caused by server downtime or failure, domain name transfers, or any other error - mechanical or human. You agree to use our servers and facilities at your own risk. In no event shall Ilati be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Ilati harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Ilati, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.
BACKUP
There are no guarantees are made of any kind, either expressed or implied, as to the integrity or availability of any backups made by Ilati. It is your responsibility to maintain local copies of your web content. The "Backup Manager" is included in each hosting plan cPanel and you can use this tool to back up your files. Any backups made by Ilati are for maintaining and restoring to our servers if the need arises.
SERVER RESOURCES
If Ilati or our server administrators determine that any site we host is using too much of the server's resources and therefore abusing the server, we have the right to suspend that domain without any notice. It is then up to you to contact us and devise a plan to get the suspended domain activated again.
SPAM POLICY
We do not allow mass email marketing sites on our servers. We simply do not allow sites of that nature to be hosted on this shared environment. Sites such as "safe lists" and "free email" are also strictly prohibited. We reserve the right to shutdown such sites, that we consider harmful to the server's performance.
Sending unsolicited commercial email ("spam"), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to an Ilati email address or web site URL is also prohibited. Ilati is committed to a zero-tolerance, anti-Spamming policy. We do not accept you sending unsolicited commercial e-mail with your account. Also, a violation is incurred if any unsolicited email is reported relating to your domain with us in anyway, regardless of what SMTP (outgoing mail server) was used to transmit the message. We react seriously to these violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy. If you have any complaints or comments regarding Spam on our network, please direct them to support@ilati.com.au or submit a support ticket in the client centre.
CONTENT POLICY
All services provided by Ilati may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Ilati from any claims resulting from the use of the service which damages the subscriber or any other party.
Pornography is prohibited on all Ilati servers. This includes sites that may infer sexual content, or links to adult content elsewhere. Ilati will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Ilati servers or any other server on the internet. Links to such materials are also prohibited.
We reserve the right to terminate any account without warning or notice if any of the above restrictions are violated and to examine the contents of any account at any time.
Uploading or creating any exploitable or aggressive materials on our servers is strictly prohibited. Any tools we locate that may be used to exploit the operating system, or any operating system, will result in immediate account termination with no refund. This includes things such as buffer overflow programs and devices to attack or harass other internet users. Ilati reserves the complete discretion to determine what materials fall under these headings.
Ilati reserves the right to amend our Terms and Conditions at any time and without notice.
